(hereinafter referred to as "WEPS") shall have the right to use my personal data, which may include the transfer of data and personal information to its related companies, subsidiaries, holding company, external partners, and affiliate companies, including their outsourcing partners.

Pursuant to the Personal Data Protection Act 2010 ("PDPA"), as amended by the Personal Data Protection (Amendment) Act 2024, WEPS values your privacy and is committed to protecting your personal information in compliance with the laws of Malaysia.

Key Updates:

  1. Data Controllers and Data Processors:- The term "data user" has been replaced with "data controller" to align with international standards. Data processors are now directly obligated to comply with the security principle, with penalties for breaches.
  2. Sensitive Personal Data:- The definition of "sensitive personal data" has been expanded to include "biometric data," which refers to personal data resulting from technical processing relating to the physical, physiological, or behavioral characteristics of a person.
  3. Cross-Border Data Transfers:- The previous whitelist regime for cross-border transfers has been removed. Personal data may now be transferred to countries with substantially similar laws or where the country ensures equivalent levels of protection.
  4. Data Breach Notifications:- Data controllers are required to notify the Personal Data Protection Commissioner and affected data subjects of personal data breaches as soon as practicable, especially if the breach is likely to cause significant harm.
  5. Appointment of Data Protection Officer (DPO):- Data controllers and data processors are required to appoint a DPO responsible for ensuring compliance with data protection regulations.
  6. Data Portability:- Data subjects have the right to request the transmission of their personal data to another data controller of their choice, subject to technical feasibility and compatibility of the data format.

WEPS reserves the right to amend this policy at any time and shall place a notice of such amendments on the website (www.weps.com.my) or via any other method WEPS deems suitable.
